Acceptable Use Policies

1. Conformance

1.1. Explicitly acceptable uses of our systems are for domain name redirection and hosting, website hosting, email retrieval or forwarding, server application hosting in the form of dynamic websites. Any other use of the system not explicitly allowed or denied may be permitted, contact us to enquire.

1.2. These conditions apply to all services and data provided by Treehouse Networks Ltd. All data hosted or transmitted on the Treehouse network is subject to random administrative checks and may be summarily removed if found not to be in conformance with these acceptable use practices.

1.3. We reserve the right to withdraw any service with all fees remaining owing if it is found not to be in conformance with these terms and conditions. Conditions in this document supercede any conflicting conditions of service specified in any other service agreement for services on the Treehouse Network.

1.4. We reserve the right to add items to these conditions at any time. Existing customers will be notified of any changes and allowed a short transition time should their content be against any new use restrictions. Additions of allowable services are under no notification obligations. The amendment of this document shall apply in place of the original contractual agreement of acceptable use of services for all customers.

2. Website Content

2.1. 'Warez' software is permitted provided its publication is permitted by the authors. Implicit authorization is assumed for any freeware, shareware, or open sourced downloads. All executable applications are required to be zipped or otherwise disabled from server activation unless given explicit administrator permission.

2.2. The following web site content falls under the Section 3, Network Abuse and Misuse, clause conditions and resolution.

  1. Providing illegal services or advice
  2. Advocating services illegal to the location of receipt
  3. Publishing private information without the consent of the individual concerned

2.3. Subject to the administrators discretion and reasonable publicly accepted standards the following may be allowed or rejected:

  1. Publishing pornographic materials
  2. Publishing any abusive or offensive language

3. Network Abuse and Misuse

3.1. We reserve the right to withdraw any service rendered if given reasonable proof of network misuse or if requested to do so by our upstream service provider (Orcon New Zealand) or any of their upstream service providers.

3.2. Network misuse is any use of, over, or via The Internetwork which effects other users of the network not in line with the developed standards of netiquette. That is any use of the network for which a reasonable and proven complaint is forwarded or can reasonably be expected. This includes but is not limited to:

  1. UCE, UBE, spam or any other form of unsolicited e-mail
  2. Providing illegal services or advice
  3. Advocating services illegal to the location of receipt
  4. Objectionable pornographic material. Subject to the Treehouse administrators discretion and reasonable publicly accepted standards.
  5. Publishing any abusive or offensive language
  6. Publishing private information without the consent of the individual concerned.
  7. Software causing harmful effects to other users.

These issues will be dealt with fairly but summarily as fits the form and action of the misuse.

4. Mailing Lists

4.1. Mailing lists used to promote any website or data hosted by us must conform to the generally accepted Confirmed Opt-In standards which can be found at Mail Abuse Prevention System (MAPS). These standards are now codified as law in many countries.

4.2. Additional to these guidelines we may require access to the confirmation records in processing complaints. Such access shall be regarded as strictly confidential and for the period of the complaint processing only.

4.3. We are able to advise on or provide software for correctly handling of your mailing lists if you are unsure of how to do this within the guidelines.

4.4. This includes mailing lists used through other services than ours. Unfortunately misuse of mailing lists (spamming) has become such a large problem it is now cause for removal of all Internet services for spammers. Any clients not conforming to these standards will be terminated until such time as they can prove they will do so.

5. Force Majeure

5.1. If either party is unable to perform any obligation under this Agreement because of a matter beyond that party's reasonable control such as lightning, flood, exceptionally severe weather, fire, explosion, war, civil disorder, industrial disputes (whether or not involving that party's employees), or acts of local or central Government or other competent authorities or events beyond the reasonable control of that party's suppliers, the party will have no liability to the other for that failure to perform.

5.2. In cases of extended network downtime, we will endeavour to provide if possible alternative services at no extra cost than if the Treehouse Network had been resumed to normal operational status.
